Funding Trusts with Retirement Assets

Tax-sheltered retirement assets make up a large part of many estates. These assets can be transferred to trusts, but there are complex tax pitfalls if the trust is not drafted and administered properly. Estate planners must understand the tax issues so they can draft the trust properly. Attendees will learn how to draft and administer trusts, to avoid catastrophic tax problems. Specific topics include:

  • The circumstances in which tax deferral can be lost, protected and/or extended
  • Good drafting techniques
  • How retirement assets should be properly administered under the trust
