Contempt Trends and Beyond

This program will discuss recent case law regarding contempts, and will clarify the confusion among attorneys as to certain issues related to contempts (procedural as well as substantive). Topics include:

 

  • Appropriate contempt procedures such as when and what counterclaims are available;
  • Procedural issues related to service of Complaint and Summons for Contempt;
  • What to consider when considering whether there is or isn’t an unequivocal order or judgment;
  • What to consider if your case seems to fall in between a contempt and a modification; and
  • Issues regarding an award of attorneys’ fees (obtaining and collecting).
