In anticipation of the adoption of the Massachusetts Uniform Trust Code, this program will show what differences can be expected in trust practice as a result of the passage.

Topics include:

  • Available institutional trustees, how they do the job of acting as a trustee and where to find a competent one;
  • When a trustee can be expected to be very active and when not, and what typical funding considerations are;
  • What type of guidance will trustees look for from the attorney for a trust or estate; and
  • Why a thorough understanding of the UPIA is essential in trust administration.

The panelists will also discuss ethical considerations including, why the Client Security Board annually reports that a majority of its payouts are the result of neglect or misfeasance of attorneys acting as fiduciaries.
