U.S. Court of Appeals for the First Circuit provisions on electronic filing of documents; Adoption of amendments to local rules; Adoption of amendments to internal operating procedures

Administrative order regarding case management/electronic case files system ("CM/ECF")

The U.S. Court of Appeals for the First Circuit has adopted provisions to govern the electronic filing of documents in cases before the court. Effective Oct. 13, the court will permit filings to be made by means of the court's electronic filing system.

Effective Jan. 1, use of the electronic filing system is mandatory for all attorneys filing in this court, unless they are granted an exemption, and is voluntary for all non-incarcerated pro se litigants proceeding without counsel. These provisions may be amended from time to time, with or without prior notice, by further order of the court. The clerk may make changes to the procedures for electronic filing to adapt to changes in technology or to facilitate electronic filing. Any changes to procedures will be posted on the court's Web site. The court may deviate from these procedures in specific cases if deemed appropriate in the exercise of its discretion.

Notice of adoption of amendments to
local rules

The U.S. Court of Appeals for the First Circuit previously provided notice of proposed amendments to Local Rules 3.0(a) and (b), 11.0(b) and (c)(2), 25.0, 27.0(b), 30.0(e), 31.0(a)(1) and (b), 32.0(a), 33.0(a)(1)(A), 35.0(c), 36.0(d), 39.0(b)(1), 40.0(a), and 45.1(c). The court solicited comments and all comments were carefully considered. The court hereby provides notice of the adoption of the amendments, with some additional minor modifications. The amendments relate to the court's adoption of an electronic document filing system. The effective date of the amendments is Oct. 13.

Notice of adoption of amendments to
internal operating procedures

The U.S. Court of Appeals for the First Circuit previously provided notice of proposed amendments to Internal Operating Procedures I(B), III(C), IV(A) and (C), V(A) and (D), VI(A) and (B), VIII(E), IX(C), and XI. The court solicited comments and all comments were carefully considered. The court hereby provides notice of the adoption of the amendments, with some additional minor modifications. The amendments relate to the court's adoption of an electronic document filing system. The effective date of the amendments is Oct. 13.

Notice of final amendment to
Internal Operating Procedure II(A)

On June 19, 2009, this court amended Internal Operating Procedure II(A), on an immediate basis, to take account of recent changes in the process for admitting attorneys to this court's bar. At the same time, the court solicited comments. No comments were received.The court hereby provides notice of the final adoption of the amendments made on June 19.

Notice of adoption of amendment to
Local Rule 46.0(f)

On June 9, this court issued Notice of Proposed Amendment to Local Rule 46.0(f). The amendment modifies slightly the requirements for appearance and argument by law students. There are also corresponding changes to the required forms. No comments were received. The court hereby provides notice of adoption of the amendment.

Notice of final amendment ot Local Rule 47.0

On May 18, this court amended Local Rule 47.0, on an immediate basis, to reflect a change in the number of members of the Advisory Committee on Rules. At the same time, the court solicited comments. No comments were received. The court hereby provides notice of the final adoption of the amendments made on May 18.
