Senate passes comprehensive legislation impacting probate community
Today, the Senate passed comprehensive legislation impacting the
probate community that includes: technical corrections to the
Uniform Probate Code, the Uniform Trust Code and gives the court
the authority to collect fees under the new probate code. This
legislation is sorely needed in advance of the effective date of
the probate code which is January 2, 2012. The Uniform Trust Code
contained in this measure will replace the current Article VII of
the probate code.
This bill will now head to the House for approval. Although the
House previously passed the uniform trust code, the bill passed by
the Senate today also includes the probate code technical
corrections and the fee language and therefore must return to the
House.
The Massachusetts Bar Association will continue to work with
Probate and Family Court Chief Justice Paula M. Carey, the
Massachusetts Bankers Association and the Boston Bar Association to
advocate for swift passage of this vital legislation prior to the
effective date of the Uniform Probate Code.
