A Trust Series You Can Trust: A Comprehensive Guide to Trust Practice - Session III

The Mass Health Agency (Medicaid) is a silent partner in virtually every trust drafted. The contrast between trust law and Medicaid regulations are confusing and improperly drafted trusts can impact your client if they ever need government assistance, even decades later.

This program will cover how a discretionary trust drafted in 1989 resulted in a denial of Mass Health benefits for a nursing home resident in 2010. Our expert faculty will discuss the case law upon which Mass Health based their decision. They will also review examples of testamentary trusts and irrevocable trusts that will withstand Mass heath examination.

Topics include:

  • How to draft a trust in order to protect client assets in the event they need Medicaid at a future date;
  • Current case law and new developments; 
  • Traps for the unwary; and 
  • What to do when things go wrong.
