Recent increases to the federal estate tax exemption have further shifted the primary concern of many estate planning clients away from tax planning and toward asset protection planning.

This workshop will provide an overview of the planning issues and techniques available to:

  • Limit the application of the Massachusetts elective share
  • Protect assets in the context of divorce
  • Protect assets from creditors
  • Protect assets in order to become eligible for government benefits, including Medicaid

In addition, the workshop will include hypothetical planning scenarios, relevant case law and sample trust provisions.
