Please join the Massachusetts Bar Association's Development and Construction Law Practice Group for a 90-minute program that will focus on recent developments in Massachusetts law relating to climate change. This program is part one of a two-part series. The panelists will address: 

  • The new and historic Massachusetts climate change law, “An Act Creating a Next Generation Roadmap for Massachusetts Climate Policy,” signed by Governor Charlie Baker in March 2021; the new Climate Resilience Design Guidelines being created by the commonwealth; and practical advice and risk management considerations for attorneys representing design professionals.
  • The need for changes to regulations and permitting procedures for greater resiliency in projects and more resilient neighborhoods; short-term and long-term implications for real estate, including protecting against risks of disinvestment and gentrification; and why environmental justice considerations are a key component of resiliency.
  • Pending regulatory changes at the federal level and evolving climate disclosure criteria -- including recent Federal Trade Commission and Securities and Exchange Commission guidance -- and how that impacts risk and liability for owners and operators; what that might mean for underwriting and credit rating considerations; and due diligence assessments for current holdings and future investment (divestment) decisions.
