We are experiencing what had once been a West Coast phenomenon — lawyers who increasingly resist or refuse to take part in joint sessions. Professor Dwight Golann will discuss potential strategies and answers to questions, such as:

  • Why is this happening?
  • Are there ways to accomplish the functions of a joint session without holding one?

Golann invites you to be a "fly on the wall," viewing videos he has filmed of leading mediators across the United States, Africa and Asia. After seeing how other mediators use joint sessions and caucuses, attendees will be invited to reflect in small groups about whether they want to apply these techniques in their own practices.

Golann is a law professor at Suffolk University and author of Mediating Legal Disputes and Sharing a Mediator’s Powers, both published by the American Bar Association, and other books. An active mediator, he is a recipient of the Lifetime Achievement Award of the American College of Civil Trial Mediators and the ABA’s 2021 Award for Outstanding Scholarship in Dispute Resolution.
