Late last night, the Senate enacted Massachusetts Bar
Association sponsored legislation that would allow attorneys to ask
questions directly to potential jurors.
It would also permit plaintiffs to specify an amount for damages
bringing Massachusetts in line with 39 other states permitting
attorney conducted voir dire. The bill gives discretion to
judges to impose reasonable limitations on the voir dire
process.
The bill is currently pending with Gov. Deval L. Patrick. He has
10 days to act. The MBA will continue to advocate for the passage
of this legislation along with the Massachusetts Academy of Trial
