'Solve It 7': Tree Trouble

Harnais

"If you have a neighbor who has a tree whose limbs are coming on your property, you have the right to cut those limbs."

MBA President-elect Robert W. Harnais, WHDH TV (Channel 7), February 19

In this segment of "Solve It 7" Harnais provided legal analysis on the case of a homeowner whose house was damaged when branches from a neighbor's tree crashed onto her roof. According to Harnais, a homeowner has a right to cut tree limbs down if they extend onto your property.

New plea bargain rules

Elikann

"I would concede that, if a prosecutor agrees to a lesser charge based on an agreement, the prosecutor should not have the rug pulled out from underneath him."

MBA Criminal Justice Section Vice Chair Peter Elikann, Massachusetts Lawyers Weekly, February 12

Elikann was quoted in a Massachusetts Lawyers Weekly story about recent changes made by the Supreme Judicial Court to rules governing pleas and plea bargains. "Neither party has to ultimately agree with what the judge says or does, but it's very, very helpful in resolving cases to see what the judge would consider," said Elikann on a change to Rule 12.
