"Building contractor’s suit against insurer revived," Massachusetts Lawyers Weekly (April 17). MBA President Grace V.B. Garcia and MBA member James L. Rudolph discussed an Appeals Court decision that a general contractor for a construction project could sue a subcontractor's insurance carrier for delayed payment of costs incurred in litigating a personal injury claim that it had agreed to defend and indemnify under a reservation of rights.
"A good fit: law firms find time is right to downsize," Massachusetts Lawyers Weekly (April 17). MBA member Elizabeth N. Mulvey was quoted in an article about the recent trend of Boston law firms downsizing their office spaces.
"Chapter 7 debtor is denied discharge of student debt," Massachusetts Lawyers Weekly (April 17). MBA Complex Commercial Litigation Section Council member Francis C. Morrissey and MBA member Jordan L. Shapiro commented on a federal Bankruptcy Court judge's decision that a Chapter 7 debtor with no present ability to repay $200,000 in student debt was not entitled to an undue hardship discharge under §523(a)(8) of the U.S. Bankruptcy Code.
