  • "Supreme Court-mandated ‘equity theft’ fix gets mixed reviews," Massachusetts Lawyers Weekly (Aug. 12). MBA members Hon. Frank J. Bailey (ret.) and John D. Finnegan discussed a new Massachusetts law stemming from the Supreme Court's 2023 decision that "home equity theft" from delinquent taxpayers is unconstitutional. 

  • "Lawyer disqualified from handling real estate dispute," Massachusetts Lawyers Weekly (Aug. 12). MBA Ethics Committee member Alan E. Brown and MBA members Sara N. Holden and Allen N. David commented on a Superior Court judge's decision to disqualify an attorney from representing defendants in a real estate dispute because he represented the plaintiff's entities in previous matters and allegedly advised both sides of the transaction at issue.

  • "$18M Chapter 93A award vacated in noncompete case," Massachusetts Lawyers Weekly (Aug. 12). MBA member Michael J. Lambert discussed an Appeals Court decision that a company could not be held liable under Chapter 93A for allegedly aiding and abetting Massachusetts-based employees in violating their restrictive covenants and fiduciary duties because the conduct occurred “primarily and substantially” outside the state.

  • "Diversity, equity and inclusion vs. merit, excellence and intelligence: Which equation is misguided?" Massachusetts Lawyers Weekly (Aug. 12). MBA Diversity, Equity and Inclusion Committee member Theresa N. Coney wrote an article stressing the continued importance of DEI-informed hiring practices in the legal profession and other industries.
