MBA Past President Marsha Kazarosian and MBA member Walter Costello explained why the financial limit on a couple's under-insurance policy has prevented them from receiving a payout to compensate for injuries they suffered in a 2017 crash.
- "SJC: no fiduciary duty owed to IRA beneficiary," Massachusetts Lawyers Weekly (Nov. 4). MBA member Richard M. Gelb discussed a Supreme Judicial Court decision, which found that the commercial custodian of non-discretionary individual retirement accounts did not owe a fiduciary duty to a named beneficiary, but that the beneficiary could maintain a Chapter 93A claim alleging that the beneficiary had unreasonably withheld funds.
