"State employee’s survivors can’t get accidental death benefits," Massachusetts Lawyers Weekly (April 7). MBA member Vincent A. Murray Jr. discussed a Contributory Retirement Appeal Board decision that survivors of a state employee who was killed in a car accident while returning to the office from an offsite meeting were not entitled to accidental death benefits.
"Later negligent acts within repose period salvage med-mal case," Massachusetts Lawyers Weekly (April 7). MBA members David P. McCormack and Elizabeth N. Mulvey commented on a Supreme Judicial Court decision that a medical malpractice claim was not time-barred because the plaintiff also alleged later negligent acts not predicated on acts or omissions outside of the seven-year statute of repose.
