  • “Should opioids be banned in court over fears of exposure?” Associated Press, various news outlets, including Worcester Telegram (Dec. 3). MBA Chief Legal Counsel Martin W. Healy was quoted in an article about a Trial Court proposal to ban opioids from courtrooms.

Following up on the MBA’s Conflict Resolution Week events, DR Section Council member Michael A.   • “Pre-litigation fees can’t be recovered under 93A,” Massachusetts Lawyers Weekly (Dec. 4). MBA members Kevin J. O’Connor and Erin K. Higgins were quoted about a recent Superior Court Business Litigation Session decision (Beninati, et al. v. Borghi, et al.), which determined that plaintiffs in a successful Chapter 93A suit were not entitled to attorneys’ fees that pre-dated the filing of the suit.
  • “ SJC to address ‘fair market value’ in car repossessions,” Massachusetts Lawyers Weekly (Dec. 4). MBA member Josef Culik was quoted about an upcoming SJC decision in Williams v. American Honda Finance Corporation, which will determine how much credit a debtor can receive from the sale of the debtor’s car at auction under state law.
