  • "MassHealth notches key win on annuities," Massachusetts Lawyers Weekly (June 21). MBA Probate Law Section Council member Carol Klyman commented on a Superior Court judge's decision finding that the state, and not the named beneficiary, is entitled to the residue of an annuity purchased by a man prior to his death to make his wife eligible for MassHealth nursing home care benefits.

  • "Appeal in mass tort case deemed untimely," Massachusetts Lawyers Weekly (June 21). MBA members Kevin T. Peters and Vincent J. Pisegna discussed a First U.S. Circuit Court of Appeals decision finding that the Federal Rules of Bankruptcy Procedure governed mass tort claims aggregated in U.S. District Court as “related to” a pending bankruptcy proceeding.
